Last Friday, May 15, through General Resolution 5848/2026, ARCA established how the employment certificate provided for in Article 80 of the Employment Contract Law must be issued and delivered.
The regulation is issued following the amendments made by the Labor Modernization Act to Article 80 of the Labor Code, which introduced changes to both the timeframe and the procedure for issuing and delivering the certificate.
Among the main changes, the deadline for complying with this obligation was extended; employers now have 45 business days from the end of the employment relationship (previously, the deadline was 30 calendar days).
With regard to the regulations, it is established that the Employment Certificate under Article 80 of the LCT must be prepared through the “Simplificación Registral” system on the ARCA website, using Form F.984, “Employment Certificate—Article 80, LCT,” which can be accessed with a Level 2 or higher Tax ID.
The resolution provides for two types of issuance:

- Digital format
The main change is that the certificate can now be issued digitally; the employer simply needs to log in using their Tax ID, without the need for a digital signature on the document. Once generated, the employee can download it directly from the “Trabajo en Blanco” service on the ARCA website.

- Physical format
For physical delivery, the certificate is generated through the same Registry Simplification system and printed in duplicate. To be valid, it must bear the signature of the employer or an authorized representative and be made available to the employee at the company’s headquarters. The original is given to the employee, and the duplicate remains with the employer.
To issue the certificates, the system will automatically use the information stored in ARCA's databases corresponding to:

- Registration of new hires, terminations, and changes to employment records.

- Reported payroll statements.

- Affidavits of Social Security Contributions.
Furthermore, the regulations clarify that when the certification covers periods prior to July 1994, it must be supplemented with a statement prepared by the employer based on the information contained in the payroll records.
Finally, the ANSES PS 6.2 certificate of services and compensation will be generated through the online service provided by ANSES, which can be accessed via the “Simplificación Registral” system available on the ARCA website. To generate the certificate, the information available in the ARCA and ANSES databases will be used.
The resolution also stipulates that workers covered by the SIPA may access their employment records through the “Trabajo en Blanco” service on the ARCA website in order to:

- Check your registration status (registrations, cancellations, and changes) and print the “Employee Certificate”

- Obtain the “Digital Certificate of Employment Income (CDIL),” which will include your reported earnings for the past six months and feature a QR code to verify its authenticity.

- Download the Article 80 employment certificate issued digitally by the employer.

- Access the “Feedback Inbox” to report any potential inconsistencies or irregularities related to employment registration or the certificates issued.
The new regulations aim to simplify both the preparation and issuance of employment certificates, while also making it easier for workers to access their employment records digitally.
It should be noted that the regulations do not include the certificate issued by the company that details other matters related to the employment relationship, such as the tasks or duties performed and the training completed by the employee, which are also required under Article 80 of the LCT.
